Please read these Terms and Conditions (“Terms”) carefully before using the website located at www.harmonyabacenters.com (the “Site”) or receiving services from Harmony ABA Centers (“Company,” “we,” “our,” or “us”), an ABA therapy provider located in Katy, Texas.

By accessing or using our Site, contacting us for services, or enrolling your child in our program, you (“Client,” “Parent,” “Guardian,” or “you”) agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use our Site or engage our services.


1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Harmony ABA Centers. Your use of the Site, submission of any contact or intake form, or acceptance of services constitutes your acknowledgment that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to update or modify these Terms at any time. The most current version will always be posted on this page with the updated effective date. Your continued use of the Site or services after any changes constitutes acceptance of the revised Terms.

2. Description of Services

Harmony ABA Centers provides Applied Behavior Analysis (ABA) therapy and related behavioral health services to children with autism spectrum disorder (ASD) and related developmental conditions. Our services include but are not limited to:

  • Comprehensive functional behavior assessments (FBA) and skills assessments
  • Individualized treatment plan development and implementation
  • Direct one-on-one ABA therapy delivered by Registered Behavior Technicians (RBTs) supervised by Board Certified Behavior Analysts (BCBAs)
  • Parent training and caregiver coaching
  • Progress monitoring, data collection, and regular treatment plan updates
  • Coordination with schools, medical providers, and other therapists as appropriate

All clinical services are provided by qualified, licensed, and credentialed professionals. Harmony ABA Centers operates in compliance with all applicable Texas state licensing requirements and the ethical guidelines of the Behavior Analyst Certification Board (BACB).

3. Eligibility and Enrollment

To be eligible for ABA therapy services at Harmony ABA Centers, the following conditions generally apply:

  • The client must be a child or individual with a confirmed or suspected diagnosis of autism spectrum disorder or a related developmental condition.
  • A parent or legal guardian must provide written consent for all clinical services.
  • Insurance authorization (where applicable) must be obtained prior to the commencement of services.
  • All required intake paperwork, including consent forms and health history documents, must be completed in full before the first clinical session.

Harmony ABA Centers reserves the right to accept or decline enrollment requests at its sole clinical and operational discretion, and to discontinue services where clinically appropriate or where these Terms have been violated.

4. Appointments, Cancellations, and No-Shows

Consistent attendance is essential for the effectiveness of ABA therapy. To support your child’s progress and respect the time of our clinical staff, the following appointment policies apply:

Cancellations

We require a minimum of 24 hours’ advance notice for all cancellations or schedule changes. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee as outlined in your service agreement.

No-Shows

Repeated no-shows or late cancellations without notice may result in the reassignment of your scheduled session time, temporary suspension of services, or discharge from the program at the discretion of your child’s clinical supervisor.

Attendance Expectations

To maximize therapeutic outcomes, we recommend that clients attend all scheduled sessions. Frequent absences may limit the effectiveness of your child’s individualized treatment plan and may affect insurance authorization for continued hours.

5. Payment, Insurance, and Financial Responsibility

Insurance Billing

Harmony ABA Centers accepts most major insurance plans and Texas Medicaid (STAR and STAR Kids). We will make reasonable efforts to verify your insurance benefits and obtain prior authorization before services begin. However, insurance verification is not a guarantee of payment. You are ultimately responsible for any amounts not covered by your insurance plan, including deductibles, co-payments, co-insurance, and non-covered services.

Financial Responsibility

By enrolling in services, you agree to be financially responsible for:

  • All applicable co-pays, deductibles, and co-insurance as determined by your insurance plan
  • Any services rendered that are denied by your insurance carrier for reasons including but not limited to lapsed coverage, failure to obtain prior authorization, or lack of medical necessity determination
  • Private pay fees for services not covered by insurance, in accordance with the fee schedule provided at intake

Billing Disputes

If you have questions or concerns about a bill, please contact us within 30 days of receiving your statement. We will work with you in good faith to resolve any billing discrepancies.

Collections

Balances outstanding beyond 90 days may be referred to a collection agency. You agree to be responsible for any reasonable collection costs, including attorney’s fees, incurred in collecting overdue amounts.

6. Confidentiality and HIPAA

Harmony ABA Centers is a covered entity under the Health Insurance Portability and Accountability Act (HIPAA) and is committed to protecting the confidentiality of all client health information. All clinical records, assessments, treatment plans, and session data constitute Protected Health Information (PHI) and are handled in accordance with HIPAA regulations and our Notice of Privacy Practices.

We will not disclose your child’s PHI to third parties without your written authorization, except as permitted or required by law (e.g., for treatment, payment, healthcare operations, or mandatory reporting obligations under Texas law).

You have the right to access your child’s clinical records, request amendments, and receive an accounting of disclosures as described in our Notice of Privacy Practices, available upon request.

7. Parental Consent and Authorization

All clinical services provided to minor clients require the prior written consent of a parent or legal guardian. By enrolling your child, you represent and warrant that:

  • You are the parent or legal guardian of the minor client with full legal authority to consent to their medical and behavioral health treatment
  • You have disclosed all relevant medical, psychiatric, and behavioral history relevant to your child’s care
  • You understand and consent to the nature, risks, and alternatives of ABA therapy as explained during the intake process
  • You authorize Harmony ABA Centers to communicate with other treating providers, educators, and insurance representatives as necessary for your child’s care

8. Mandatory Reporting Obligations

All clinical staff at Harmony ABA Centers are mandatory reporters under Texas Family Code Chapter 261. Our staff are legally required to report any reasonable suspicion of child abuse, neglect, or exploitation to the Texas Department of Family and Protective Services (DFPS) or appropriate law enforcement. These reporting obligations exist regardless of any request for confidentiality and cannot be waived by consent.

9. Website Use and Intellectual Property

Permitted Use

You may use our Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable local, state, or federal law
  • Transmit any unsolicited commercial communications (spam)
  • Attempt to gain unauthorized access to any part of the Site or its related systems
  • Use automated tools to scrape, crawl, or data-mine the Site
  • Post or transmit any content that is false, misleading, defamatory, or harmful

Intellectual Property

10. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HARMONY ABA CENTERS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Site will be available, uninterrupted, or error-free; (b) any information on the Site is accurate, complete, or current; or (c) the Site is free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HARMONY ABA CENTERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you in full.

12. Indemnification

You agree to indemnify, defend, and hold harmless Harmony ABA Centers and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any information you provide to us that is inaccurate, misleading, or provided without proper authorization.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our services that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County or Fort Bend County, Texas.

Before initiating any formal legal proceeding, you agree to first contact us in good faith at support@harmonyabacenters.com and attempt to resolve the dispute informally within 30 days.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any signed service agreements or consent forms, constitute the entire agreement between you and Harmony ABA Centers with respect to the subject matter herein and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
